Today’s Action: Call on your representatives to unilaterally extend the federal eviction moratorium!

An estimated 7 million tenants in the US were behind on rent as the nation’s federal eviction moratorium expired in July. While President Biden attempted to extend the moratorium in a race against the clock, the conservative-majority Supreme Court deemed it unconstitutional in late August — and since then, things have been stagnant. We need the House to pass new legislation to extend the moratorium now. Without it, more than a million people could be facing imminent eviction.

Some states have been using pandemic aid as emergency rental assistance, but distributing those funds has proven extremely challenging in some cases. Many months into the crisis, only about 11% of the $47 billion dollars in aid has been distributed to renters and landlords to help prevent evictions.

The Supreme Court ruling demands that Congress extend the moratorium unilaterally. We need everyone to keep the pressure on their representatives until the House sets new legislation in motion — it’s the only way to protect millions of renters from eviction.

The Texas legislature and five Supreme Court justices have joined forces to eviscerate women’s abortion rights — the legislature by creating and the justices by leaving in place a system of private bounties designed to intimidate all who would help women exercise the right to choose. But the federal government has — and should use — its own powers, including criminal prosecution, to prevent the law from being enforced and to reduce its chilling effects.

Of course, the best approach would be for Congress to codify the right to abortion in federal law, although Democrats likely lack the votes to make that happen — and there is a risk that this conservative Supreme Court would find that such a statute exceeded Congress’s authority under the Commerce Clause.

But as President Biden calls for a “whole of government” response to the fact that thousands of women in Texas — and no doubt soon elsewhere — are being denied their constitutional rights, there are other solutions that already exist in federal law.

Attorney General Merrick Garland has the power, under federal civil rights laws, to go after any vigilantes who employ the Texas law to seek bounties from abortion providers or others who help women obtain abortions.

The attorney general should announce, as swiftly as possible, that he will use federal law to the extent possible to deter and prevent bounty hunters from employing the Texas law. If Texas wants to empower private vigilantes to intimidate abortion providers from serving women, why not make bounty hunters think twice before engaging in that intimidation?

For example, Section 242 of the federal criminal code makes it a crime for those who, “under color of law,” willfully deprive individuals “of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States.”

This statute — originally designed to go after the Ku Klux Klan — fits the Texas situation perfectly: The bounty seekers, entitled under the Texas law to collect penalties of at least $10,000, have been made, in effect, private attorneys general of Texas. They act “under color of state law,” and unless and until Roe v. Wade is overruled, they unmistakably intend to prevent the exercise of a constitutional right.

In addition, Section 241 of the federal criminal code makes it an even more serious crime for “two or more persons” to agree to “oppress, threaten, or intimidate” anyone “in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same.” This crime may be committed even by individuals not found to be acting “under color of law” but as purely private vigilantes, as long as they’re acting in concert with others.

Again, the Texas scheme could hardly be more perfectly designed to match the language of that section. The whole point of the Texas law, after all, is to intimidate abortion providers and others by threatening them with penalties of at least $10,000, plus legal fees, in the form of bounties to be paid to the vigilante. Even jurists who believe the Constitution does not protect abortion rights might be given pause by this seizure of private property, with unlimited penalties not tied to any actual harm suffered by the bounty hunter.

It would be particularly fitting — in tune not just with the letter but the spirit of the law — to use the Ku Klux Klan Act in this way. After all, the statute was enacted in 1871, in the aftermath of the Civil War, precisely to prevent Klansmen from lynching and other attacks on formerly enslaved Black citizens, including to prevent them from exercising their constitutional right to vote. As the Klan rampaged in the former Confederacy, Southern states didn’t simply turn a blind eye to its vigilante justice but encouraged it.

In addition to these criminal provisions, there are civil actions available under federal law, including the ability to seek and obtain court orders to halt the illegal state scheme. The Justice Department can’t directly use the civil provisions of the Ku Klux Klan Act; only the injured party can. But the All Writs Act, which permits federal courts to “issue all writs necessary or appropriate in aid of their respective jurisdictions” could allow the department to go to court to seek an order blocking the Texas law from being enforced.

The Justice Department is understandably reluctant to announce particular investigations or prosecutions before pinning down more details than are yet available. But, at some point, the need to disarm those who cynically undermine constitutional rights while ducking all normal avenues for challenging their assault on the rule of law becomes paramount.

With so much going on in the news, I know it can all feel so overwhelming.

I wanted to take a moment to share some reflections on how we can be showing our support right now and prepare for the fights ahead.

First, I want to be clear that the bill passed by the Texas state legislature banning abortions after six weeks, SB 8, is an attack on everyone’s reproductive rights.

This is not just about women’s rights, it’s universal to all genders. Reproductive justice is connected to LGBTQ rights, racial justice, and economic justice — this law impacts everyone. If you drive someone to an abortion clinic, the state of Texas can sue you for $10,000.

This law was never about limiting the number of abortions. We know that making abortions illegal doesn’t stop abortions, it just makes them more dangerous and limits reproductive care to the wealthy and privileged. Abortion will remain functionally legal for some, while the most vulnerable will seek back alley abortions or use their savings to travel out of state.

Similar to the criminalization of drugs, the white and privileged can walk around with drugs in their pocket and never get stopped and frisked. Meanwhile, it’s a different story for low-income, Black, and Brown people.

If Republicans really wanted to drive down the numbers of people who need to seek abortions, they would support free and guaranteed health care for all and make it extremely easy to access birth control and reproductive care.

But the reason this is happening in Texas is very calculated. Texas is a huge state and it has been turning more and more blue. As elections are getting more competitive, this kind of attack is intentional.

Instead of changing their views as the state changes, Republicans are so beholden to an underlying logic of white supremacy, patriarchy, corruption, greed, corporate power, and lobbying that they have nowhere to go but to restrict voting rights, further gerrymander their districts, and control people’s bodies.

But we need to keep it real, y’all: We have the ability to stop all of this right now.

We have a Democratic majority in the House and Senate and a Democrat in the White House.

This isn’t just about blaming Republicans, Democrats need to step it up and fight harder. I will be the first to tell you that our party isn’t fighting hard enough.

Democrats can either abolish the filibuster, get dark money out of politics, and expand voting rights by passing HR 1, the For the People Act, or do nothing as millions of peoples’ bodies, rights, and lives are sacrificed for far-right minority rule.

Our democracy will be flushed down the drain if people are further disenfranchised and as dark money continues to corrupt our politics and behold our lawmakers. We cannot allow this to happen anymore. Too much is at stake.

This shouldn’t be a difficult decision.

TEXAS ABORTION BAN



ACLU: 

Last night, the Supreme Court did not respond to our emergency request to block Texas' radical six-week abortion ban, Senate Bill 8.

That means the law will now take effect today – prohibiting most abortions in the state. The impact will be immediate and devastating.

This extreme and blatantly unconstitutional law bans abortions at six weeks – before many people even know they are pregnant. But, there's more.

The law also actively encourages private citizens to act as bounty hunters by awarding them at least $10,000 if they successfully sue another person for providing an abortion or assisting someone who gets an abortion at around six weeks of pregnancy.

The bounty hunting abortion ban is intentionally designed to overwhelm clinics in the state with lawsuits and legal bills, ultimately forcing them to shut down. The worst anti-women’s health care law in the country

A tough week for Texas.

The anti-voter elections bill we’d fought this entire year passed the Texas legislature on Tuesday, and the following day a raft of truly terrible new laws went into effect.

For example, anyone can now carry a gun in public without getting a permit, or going through a background check or receiving any kind of training. This, in a state that has four of the worst mass shootings in U.S. history and a crisis in gun violence against women (women in Texas are 24% more likely to be murdered with a gun than women in other states).

And now in a state that leads the country and much of the developed world in the rate of maternal mortality — because it was already so hard for women to get healthcare, family planning help or to see a doctor of any kind at all — nearly no one will be able to get a safe, legal abortion. Our state has created a system of legalized harassment with the passage of the worst anti-women’s health care law in the country, one that literally places a $10,000 bounty on anyone who supports a woman trying to exercise her basic right to control her own health and decide her own future.

That’s just some of what the people of Texas are up against thanks to our state’s radical, out of control Republican government. They’re also hard at work making scapegoats of public educators, transgender kids and immigrants — all while making Texas one of the deadliest states when it comes to Covid transmission, and keeping their donors in the energy industry happy at the expense of the lives of our fellow Texans.

The only way to change these laws and the terrible trajectory we’re on is to change the people in power.

The Texas law is an abomination and unconstitutional

This week, the Supreme Court failed to stop the implementation of an incredibly restrictive new abortion law in Texas. In failing to act, the Supreme Court is setting itself up to overturn Roe v. Wade.

Let me be clear: The Texas law is an abomination and unconstitutional. The right of women to make their own healthcare decisions, including the right to abortion, was settled by the Supreme Court nearly 50 years ago and has been upheld in case after case ever since.

We need to speak out loudly on this. Will you join me in adding your name in support of Roe v. Wade and women’s reproductive choice?

When Trump jammed three ultra-conservative justices onto the Supreme Court, we knew it would only be a matter of time before the right-wing came for Roe.

Texas abortion ban

The Supreme Court’s right-wing majority just refused to block Texas’s unconscionable new law that bans abortion after only 6 weeks — a stage when most women don’t yet know they are pregnant. It’s unconscionable.

In just a moment, I’m going to tell you how you can help in Texas right now, but first, I want to tell you the stakes.

In her dissent, Justice Sonia Sotomayor wrote:

“This equates to a near-categorical ban on abortions...Presented with an application to enjoin a flagrantly unconstitutional law engineered to prohibit women from exercising their constitutional rights and evade judicial scrutiny, a majority of Justices have opted to bury their heads in the sand.”

Yes they did. A 5-4 majority dominated by justices picked by Donald Trump and Mitch McConnell has effectively overturned Roe v. Wade in Texas. They were just too cowardly to do it outright. But in effect, that’s exactly what this ruling does.

If that’s not bad enough, this law places a $10,000 bounty on anyone who assists someone getting an abortion, even the person driving them to the clinic. And a case being brought by the Mississippi attorney general to the Supreme Court this fall could end up overturning Roe v. Wade for good.

Already, Florida Republicans are eagerly writing their own laws modeled off of the Texas ban with even more states ready to follow suit. Like their fanatical crusade against voting rights, Republicans have introduced more than 500 anti-choice bills in state legislatures this year alone: limiting reproductive freedom, restricting access to safe and legal abortion, or outright banning it.

This is just the start, unfortunately. Which is why it’s so important that we show right now that we won’t accept these unconstitutional rulings — Congress must act to enshrine the right to abortion now.

This week, following a 5-4 ruling, the U.S. Supreme Court delivered a major blow to reproductive freedom when it chose not to block Texas’s radical six-week abortion ban.

The Court has thrown the door wide open to Roe v. Wade being struck down, and now more than ever our movement must come together and make it crystal clear: Abortion is health care and health care is a human right.

Observers have speculated how today’s new ultra-right court would commence the slicing: by chipping away slowly at Roe v Wade? Or by taking the political heat and overruling it outright? Few imagined that the court would let a statute everybody concedes is flagrantly unconstitutional under the legal regime of Roe not only go into effect without being judicially reviewed but become the centerpiece of a totally unique state scheme that puts a bounty of at least $10,000 on the head of every woman who is or might be pregnant.

It wasn’t just Roe that died at midnight on 1 September with barely a whimper, let alone a bang. It was the principle that nobody’s constitutional rights should be put on sale for purchase by anyone who can find an informant or helper to turn in whoever might be trying to exercise those rights.

That, after all, is how the new Texas law works. Its perverse structure, which delegates to private individuals anywhere a power the state of Texas is forbidden to exercise itself until Roe is overruled, punishes even the slightest form of assistance to desperate pregnant women. Doctors, family members, insurance companies, even Uber drivers, are all at risk if they help a woman in need. And the risk is magnified by the offer of a big fat financial reward for whoever successfully nabs a person guilty of facilitating an abortion once a heartbeat can be detected, typically six weeks after a woman’s last period, well before most women even know they are pregnant. There is not even an exception for pregnancies resulting from rape or incest. No law remotely like this has ever been allowed to go into effect.

The prospect of hefty bounties will breed a system of profit-seeking, Soviet-style informing on friends and neighbors. These vigilantes will sue medical distributors of IUDs and morning-after pills, as well as insurance companies. These companies, in turn, will stop offering reproductive healthcare in Texas. As of a minute before midnight on 31 August, clinics in Texas were already turning patients away out of fear. Even if the law is eventually struck down, many will probably close anyway.

Worse still, if women try to escape the state to access abortion services, their families will be on the hook for offering even the smallest aid. If friends or family of a woman hoping to terminate her pregnancy drive her across state lines, or help her organize money for a plane or bus ticket, they could be liable for “aiding and abetting” a now-banned abortion, even if the procedure itself takes place outside Texas.

Adding insult to injury, if a young woman asks for money for a bus ticket, or a ride to the airport, friends and parents fearful of liability might vigorously interrogate her about her intentions. This nightmarish state of affairs burdens yet another fundamental constitutional privilege: the right to interstate travel, recognized by the supreme court in 1999 as a core privilege of federal citizenship. Welcome to Gilead!

Many wealthy women will presumably still find ways to access care. But their poor, disproportionately minority sisters will be stuck, forced to face down the barrel of unimaginably cruel choices. Desperate women will still seek abortions but will be forced to do so on the black market and in back alleys. Fewer Samaritans will risk heavy fines or imprisonment to help them. Some will die trying.

What can be done? We can give up on this court and try pressuring Congress to pass the Women’s Health Protection Actwhich would enshrine a federal statutory right to provide and receive abortion care free of these sorts of state schemes. But such a bill would die at the hands of Mitch McConnell, the minority leader, in a Senate filibuster.

And what if it were somehow to pass? Odds are that a court majority, despite having held that Congress is empowered to enact a nationwide ban on certain late-term abortions because medical procedures are part of interstate commerce, would suddenly “discover” new limits on the reach of the commerce clause as a source of congressional power and strike the act down. When the court so casually lets a law that flouts its precedents take effect, all bets are off.

Or are they? Maybe even justices deeply hostile to abortion rights can be persuaded to balk specifically at the unprecedented financial incentives this grotesque law creates to put a price on the head of every pregnant woman or girl. Shades of sex slavery and prostitution might put this privatization of law enforcement in a light even conservative jurists find unbearable. What if women chilled by this business model, or those seeking to help them to avoid unwanted motherhood, were to sue the Texas authorities who stand ready to disburse $10,000 bounties for each forbidden abortion detected or prevented?

As Justice Sotomayor said in her dissent – there were four dissents in all – the Texas law “is a breathtaking act of defiance – of the constitution, of this court’s precedents, and of the rights of women seeking abortions throughout Texas”. After a puzzling silence of a day and night, “the court finally [told] the Nation that it declined to act because, in short, the State’s gambit worked.” Even if not a single justice in the 5-4 majority rejects the ability of a state to “evade federal judicial scrutiny by outsourcing the enforcement of unconstitutional laws to its citizenry”, and even if all five of the justices in that majority stand ready to trash Roe v Wade, maybe at least one of those justices would agree that no state can hand out financial rewards to people – not only citizens in Texas but people from anywhere in the country, perhaps the world – shredding the constitution of the United States?
